These Terms & Conditions (“Terms”) govern your use of the Skye Collective website (skye-collective.com), any purchases made through the site, and any services, equipment, digital goods, or practitioner tools offered by Skye Collective LLC (“we,” “us,” “our,” “Skye Collective”).

By accessing or using our site or purchasing from us, you agree to these Terms.

If you do not agree, please discontinue use.


1. GENERAL OVERVIEW

Skye Collective LLC provides wellness-based technologies, practitioner training, neuroacoustic audio content, and related products.
We do not provide medical services, medical devices, clinical diagnosis, or treatment of any kind.

All content is intended strictly for wellness, educational, and personal development purposes.


2. NO MEDICAL CLAIMS

Our products—including NeuroWave® equipment, Lambda System components, practitioner tools, digital audio, and all custom tracks—are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease.

No content, audio, vibration, or HRV-related tool should be interpreted as medical advice or a substitute for professional medical care.


3. PAYMENT TERMS

By making a purchase, you authorize Skye Collective LLC and our third-party payment processors (Stripe, PayPal, Square, etc.) to charge your selected payment method for the full order amount, including taxes, shipping, and applicable fees.

All prices are listed in U.S. dollars (USD) unless otherwise indicated.


4. PRODUCTION & DELIVERY TIMEFRAMES

All production times, manufacturing schedules, and delivery estimates are provided as good-faith estimates only.

Because our equipment is produced in small batches or requires specialized components:

  • Production delays may occur

  • Supply chain interruptions may occur

  • Shipping carriers may be delayed

These delays do not constitute grounds for order cancellation beyond our standard refund policy.


5. EQUIPMENT DEPOSITS & CANCELLATIONS

5.1 Deposit Refund Policy

For any physical product requiring a deposit or down payment—including NeuroWave® Chairs, NeuroWave® Tables, Lambda System hardware, or any equipment:

  • All deposits are fully refundable at any time prior to shipment,

  • minus any payment processing fees, transfer fees, or banking fees incurred by Skye Collective.

These fees are non-refundable to us by payment processors and therefore cannot be returned to the customer.

5.2 Custom Colors or Custom Modifications (Optional)

If you choose to offer this later, include this clause. If not, I will delete it:

Custom upholstery, custom colors, or non-standard component selections are non-refundable once production has begun, as these require special-order materials that cannot be repurposed.

6. EQUIPMENT RETURNS & RESTOCKING FEES

6.1 Return Eligibility

Equipment may be returned within 30 days of delivery, provided it is:

  • In like-new condition

  • Free of wear, stains, damage, or misuse

  • Returned with all accessories, pads, cables, sensors, and packaging

6.2 Restocking Fee

All returned equipment is subject to a 20% restocking fee deducted from the refund total.

6.3 Return Shipping Responsibility

Customers are responsible for:

  • All return shipping costs

  • Shipping insurance (recommended but not required)

  • Proper, secure packaging to avoid damage in transit

6.4 Refund Processing

Refunds are processed within 10–14 business days after the returned product is received and inspected.


7. SHIPPING DAMAGE & LOST PACKAGE POLICY

7.1 Reporting Timeframe

Customers must inspect shipments immediately upon delivery.

Any damage, missing parts, or defects must be reported to Skye Collective within 72 hours, including:

  • Photos of the equipment

  • Photos of packaging

  • A brief written description

Failure to report within this timeframe may reduce or eliminate our ability to file a carrier claim or provide replacements.

7.2 Transit Damage

Transit damage is typically handled through the carrier’s insurance process (UPS, FedEx, freight carriers).
We will support you in filing claims but cannot guarantee carrier approval.

7.3 Lost or Stolen Packages

Once a carrier marks a package as delivered, Skye Collective is not responsible for theft, porch piracy, or misplacement.
Claims must be filed with the carrier.


8. INCORRECT SHIPPING INFORMATION

Customers are fully responsible for providing accurate shipping details.

Skye Collective is not liable for delays, loss, additional fees, or misdeliveries caused by incorrect or incomplete addresses provided by the customer.


9. INTERNATIONAL ORDERS

For customers outside the United States:

  • All import taxes, VAT, customs duties, tariffs, brokerage fees, and cross-border charges are the customer’s responsibility.

  • We do not reimburse international import or customs fees.

  • International delivery times are estimates only.


10. DIGITAL GOODS & NON-REFUNDABLE ITEMS

All digital goods and digital services are non-refundable, including:

  • Custom Bio-Tuning® tracks

  • Practitioner tracks

  • Tracks purchased with Skye Credits

  • Skye Credits themselves

  • Digital downloads

  • Online courses

  • Educational content

  • Access to practitioner materials once delivered

  • Any rendered, exported, or fulfilled track order

Once delivered via email, download, portal access, or practitioner dashboard, no refunds are provided.


11. PRACTITIONER LICENSES, DATA, & CERTIFICATION

11.1 Certification is Not Guaranteed

Certification requires full completion of all training criteria.
We reserve the right to deny or revoke certification for misuse or violation of Terms.

11.2 Intellectual Property Restrictions

Practitioners may not:

  • Resell audio

  • Upload tracks to streaming platforms

  • Share tracks with non-clients

  • Alter, reverse engineer, or remix tracks

  • Use tracks commercially

  • Reproduce or distribute tracks in any format

All audio content remains the exclusive intellectual property of Skye Collective LLC.

11.3 HRV & Biometric Data

We may collect biometric data (e.g., HRV values) solely for:

  • Track customization

  • Session workflow

  • Practitioner-level use

We do not store medical data, perform diagnostics, or sell/share biometric data.


12. LICENSE TO USE DIGITAL CONTENT

When you purchase a digital track or product, you receive a personal, non-commercial, non-transferable license.

You do not acquire ownership.

You may not resell, distribute, upload, or use the content commercially.


13. USE OF EQUIPMENT (IMPORTANT LIABILITY DISCLAIMER)

Customers agree that the use of NeuroWave® equipment, chairs, tables, vibration systems, or neuroacoustic audio is entirely at their own risk.

Skye Collective LLC is not responsible for:

  • Injuries resulting from improper use

  • Discomfort from extended use

  • Use while impaired, intoxicated, or fatigued

  • Use with pre-existing medical conditions without physician approval

  • Falls, slips, posture issues, or misuse of moving or vibrating components

Customers with health concerns should consult a physician before using vibration-based or neuroacoustic equipment.


14. LIMITATION OF LIABILITY (DAMAGES CAP)

To the fullest extent permitted by law:

  • Skye Collective LLC is not liable for indirect, incidental, special, punitive, or consequential damages.

  • Maximum liability for any claim shall not exceed the amount paid by the customer for the specific product or service involved.


15. CHARGEBACKS & PAYMENT DISPUTES

Filing false, unwarranted, or abusive chargebacks for valid purchases may result in:

  • Suspension of access

  • Termination of practitioner status

  • Reporting to payment processors

  • Submission of all order records and signed Terms to Stripe/PayPal

We reserve the right to present all evidence to dispute invalid chargebacks.


16. FORCE MAJEURE

Skye Collective LLC is not responsible for delays or failure to perform due to events beyond our reasonable control, including:

  • Natural disasters

  • Pandemics

  • Global supply chain interruptions

  • Labor strikes

  • War or civil unrest

  • Government actions

  • Carrier disruptions


17. WEBSITE USE & INTELLECTUAL PROPERTY

All content on this website—including text, audio, images, design elements, software, branding, and trademarks (including NeuroWave®)—is owned by Skye Collective LLC.

You may not reproduce, copy, publish, or create derivatives without written permission.


18. GOVERNING LAW

These Terms are governed by the laws of the State of California.
All disputes must be resolved exclusively in San Diego County, California.


19. SMS & COMMUNICATION CONSENT

We may send transactional SMS messages in the future (e.g., shipping updates, security verification).
We will not send marketing text messages without explicit opt-in consent.


20. MODIFICATIONS TO TERMS

We may update these Terms at any time. The latest version will always appear on this page.

Continued use of the website constitutes acceptance of any updated Terms.
